Polymarket isn't shrinking either — after peaking near $10.5 billion in March, its volume dipped through April and May before rebounding to $12.9 billion in July, a new high — but growing slower than Kalshi means its share of the combined market is falling even as its own numbers improve. The likely explanation is product mix: Kalshi leans heavily into sports contracts, the single biggest category of retail betting demand in the US, while Polymarket's volume skews toward politics and current-events markets, a smaller and more sporadic pool of demand outside election years.
Why Kalshi Keeps Losing in Court
That same sports-heavy mix is also Kalshi's biggest liability. Since July, four separate state court rulings — New York, Connecticut, Washington and, on August 28, the 9th Circuit Court of Appeals in Nevada — have rejected Kalshi's core legal argument: that its status as a CFTC-registered exchange preempts state gambling law. The Nevada loss matters more than the others because it came from an appellate court, not a district judge, which makes it a stronger precedent other circuits could cite. Washington's ruling is the most immediate problem — Kalshi has been ordered to shut down its sports, election and "mention" contracts in the state by September 2. Kalshi has already pulled its sports mention markets nationally, after the CFTC opened an internal review in mid-August into whether word- and statement-prediction contracts create manipulation risk. Polymarket has faced far fewer, lower-profile state actions, in New Mexico and Tennessee, largely because it isn't fighting the same sports-contract battle at the same scale.
Is This Legal in My State?
There's no single answer, and that's the real story under the polymarket kalshi news cycle right now. Federal registration with the CFTC gives both platforms a claim to operate nationwide, but state attorneys general are contesting that claim contract by contract, and so far the district and circuit courts hearing sports-contract cases have sided with the states. That means legality currently depends on where you live and what you're trading: election and current-events contracts have drawn less legal fire than sports contracts, and New York, Connecticut, Washington and Nevada have moved fastest against Kalshi specifically. If you're in one of those states, sports contracts are the highest-risk category to assume are settled law — they aren't yet, and the list of restricted states is likely to grow before it shrinks.
Why Investors Aren't Blinking
None of this is slowing the money. Kalshi is reportedly in talks with Sequoia and Wellington for a $750 million raise at a $40 billion valuation — roughly double the $22 billion mark it closed at in May — while Polymarket is in early talks for $1 billion at $20 billion or more, up from a $15 billion valuation in April. Both rounds are moving forward at the same time state courts are handing Kalshi losses. The likely read: investors are pricing category-wide growth and the platforms' underlying federal legitimacy under the CFTC, not the outcome of state-level sports-betting lawsuits. That's a reasonable bet only if the legal fight stays contained to a state-by-state patchwork rather than resolving nationally against the platforms, which is still an open question.
What Would Flip This?
The forward path runs through two pending circuit appeals: the 2nd Circuit on Kalshi's New York case, and the 4th Circuit on its Maryland case, argued back in May. Neither has a ruling date yet. If either circuit sides with Kalshi and reverses the district-court pattern, the state-by-state enforcement risk collapses and both platforms get a cleaner nationwide legal footing — a genuine re-rating catalyst for the whole category. If a second circuit instead affirms what the 9th Circuit found in Nevada, sports event contracts start to look like gambling under state law almost everywhere, forcing Kalshi to geofence sports out of a growing list of states right as it tries to close a $40 billion round. Until one of those rulings lands, which is unlikely before year-end, expect the current split to hold: Kalshi ahead on revenue and volume, both platforms still raising at record valuations, and sports-contract legality decided court by court, state by state.
